This document constitutes the Acceptable Use Policy (AUP), Legal Agreement, and Privacy Policy governing your use of OCEANICHOST infrastructure. By using our services, you accept full responsibility for all activity conducted through your account — whether initiated by you or by others using your credentials. In the event of a security breach, the account holder remains liable for any resulting violations of these Terms of Service (TOS) and Acceptable Use Policy (AUP).

OCEANICHOST infrastructure encompasses, but is not limited to, bandwidth, transport networks, servers, switches, IP addresses, and any other equipment used to transmit, receive, or process data. This document details both permitted and prohibited uses of our services. All OCEANICHOST users are required to read and fully understand its contents.

We reserve the right to enforce, update, modify, or amend this document at any time. We also retain the right to take appropriate action based on our assessment of conduct, at our sole discretion.

1. DEFINITIONS

"We," "Us," "Our," "OceanicHost.com" — refers to OCEANICHOST and any of its parent companies, subsidiaries, and/or affiliated entities involved in delivering the Services.

"You," "Your," "Yourself," "User" — refers to any individual or entity accessing the Website and/or purchasing or utilizing the Services.

"End Users" — refers to any individual or entity that directly or indirectly, through another user: (a) accesses or uses Your Services Content, or (b) otherwise accesses or uses the Services under your account.

"Services" — refers to any and all services offered by OCEANICHOST through its Website, including but not limited to web hosting, server management, and infrastructure management.

"Services Content" — refers to source code, files, software, processes, interfaces, data, text, configurations, media, or any other material submitted for storage, hosting, or processing through the Services.

2. USER PRIVACY

At OCEANICHOST, safeguarding your privacy is a core priority. All information collected from you is stored securely and handled with strict confidentiality. We guarantee that your personal information will never be sold, rented, loaned, distributed, or disclosed to any third party without your explicit consent. Any data you provide will be used solely for purposes to which you have agreed, such as maintaining communication regarding service updates, invoices, alerts, and other relevant business matters.

Please ensure that the information you provide is accurate and up to date so that we can effectively reach you regarding your services.

We collect information through automated means — including communication profiles and cookies — and may gather various details depending on the nature of your service, support inquiry, or sales request. This may include your name, postal address, telephone number, fax number, email address, dates and types of services provided, payment history, payment method details, payment amounts, payment dates, and domain name(s).

For transactions processed via credit card or PayPal, financial information is neither stored nor handled by OCEANICHOST. All sensitive data is transmitted through a secure, encrypted connection, indicated by the security icon in your browser.

OCEANICHOST.com uses automated data collection methods for marketing purposes on its main website. However, our client portal at https://my.oceanichost.com/ does not collect marketing-related data from your visits.

To enhance your browsing experience, OCEANICHOST uses cookies, similar technologies, and third-party services to display personalized content, relevant advertising, and to store your preferences.

3. DMCA, COPYRIGHT, FREEDOM OF EXPRESSION & APPLICABLE LAW

The Digital Millennium Copyright Act (DMCA) is a United States federal law. While it establishes a framework for addressing copyright infringement and provides guidance for online service providers, our EU-based data centers operate in compliance with local European copyright legislation.

Within the European Union, compliance with the EU Directive on Copyright in the Digital Single Market is essential. Users and content creators must be aware of the specific copyright laws applicable to their jurisdiction and the content they host, as regulations vary by country.

Our commitment aligns with the principles set forth in Article 10 of the European Convention on Human Rights, which protects the fundamental right to freedom of expression. OCEANICHOST does not engage in censorship of customer content. However, it is important to distinguish between hosting lawful speech and hosting copyright-infringing material. This commitment to free expression does not authorize the use of our services for activities prohibited under these Terms of Service.

We advocate for freedom of expression, support open-source software, prioritize privacy and anonymity, and endorse network neutrality. While we are committed to being a free-speech-friendly hosting provider, we do not offer bulletproof hosting and strictly prohibit malicious activities. We refrain from removing content solely because it may be considered offensive, in order to uphold our commitment to free speech.

4. PROHIBITED CONTENT

We maintain an open-minded approach to content hosting. However, the following types of content and activities are strictly prohibited on our platform:

  • Child sexual abuse material (CSAM) of any kind
  • Content promoting illegal drugs or the abuse of legal substances
  • Content involving animal exploitation, including zoophilia or bestiality
  • Threatening, racially motivated, or otherwise abusive content
  • Fraud, multi-level marketing (MLM), pyramid schemes, or any other fraudulent activities
  • Distributed Denial of Service (DDoS) attacks or network flooding
  • Ransomware, botnets, viruses, malware, or IRC bots
  • Spamming, phishing, or scam websites
  • Any activity that may result in IP or domain blacklisting (e.g., Spamhaus)
  • Network abuse or IP spoofing
  • Violation of intellectual property or authors' rights
  • Unauthorized access to computers, networks, or surveillance systems
  • Websites promoting or facilitating terrorism

Legal adult (18+) and gambling content is permitted, provided it complies with the local regulations of the jurisdiction where the content is hosted. Any content not explicitly listed above is considered permissible, subject to applicable laws.

If your use of our services jeopardizes the health or safety of any individual, we reserve the right to suspend your service immediately.

OCEANICHOST bears no liability for legal issues arising from data hosted by customers on our servers. The legality and credibility of hosted content are the sole responsibility of the customer.

When law enforcement agencies present an official request or legal order regarding customer information, we will cooperate and assist in their investigation. Law enforcement officials may contact us directly via our ticketing system — Open Ticket.

5. CONTENT & NETWORK USE RESPONSIBILITY

You bear full responsibility for all content and activities hosted on our servers and network. OCEANICHOST upholds strong anti-censorship principles and will only intervene when content violates these Terms of Service. We accept no liability for the use of domains registered through our services, nor for the content published on websites associated with those domains and hosted on our network.

If you become aware of any unlawful activities on our network, please report them through our ticketing system — Open Ticket.

6. DOMAIN NAMES

Registration & Ownership: When you register a domain through our billing system, it is initially registered using the information you have provided. If your billing account lacks the necessary details to complete registration, the domain will be registered using OCEANICHOST company information by default. While OCEANICHOST may appear as the registered owner in this scenario, we act solely as an intermediary — actual ownership of the domain belongs to you from the date of registration.

To avoid potential issues related to inaccurate WHOIS data, domain disputes, or complaints, we strongly recommend updating your domain registration details to reflect your own information as soon as possible.

You may also submit a formal request to transfer the domain name registration into your own name, which will make you the registered owner with the relevant registry operator. Such a transfer requires your written agreement to comply with any terms and agreements to which OCEANICHOST is bound as the current registrant.

Special Characters & IDNs: Special characters are not permitted in domain name registrations. Domain names must be between 3 and 63 characters in length, consisting only of letters (a–z), numbers (0–9), and hyphens (not as the first or last character). Characters such as "&" and "#" are prohibited, and Internationalized Domain Names (IDNs) are not supported. Our system automatically strips IDNs and special characters upon activation, which may result in domains with missing characters. Refunds will not be issued for domains affected by the use of special characters, as our profit margins on domain registrations are minimal. The use of special characters in domain names is often associated with phishing and fraudulent activity, and we strongly advise against it.

Compliance: OCEANICHOST operates in full compliance with the legal requirements established by the relevant domain registries and our Terms of Service. You agree not to engage in any activities prohibited by these Terms using domain names registered through our Services.

Limited Liability: Our liability is strictly limited to domain registration matters and does not extend to the content hosted on any domain within our operational scope.

Domain Withdrawal or Locking: A domain registered with OCEANICHOST may only be withdrawn or locked upon presentation of a valid court order issued and recognized by the appropriate legal authorities.

Content-Related Suspension: We do not suspend domains based on their content when that content is not hosted on our servers. Suspension is considered only when content hosted on our servers violates the Acceptable Use Policy, and in such cases, only the hosting service is affected — the domain name itself remains unaffected.

Reporting Illicit Content: Users who encounter illicit content are encouraged to report it to the hosting provider responsible for serving that content, as they possess the authority to take appropriate action.

7. SPAM & UNSOLICITED COMMERCIAL EMAIL (UCE)

Zero-Tolerance Policy: OCEANICHOST enforces a strict zero-tolerance policy regarding Unsolicited Commercial Email (UCE), commonly known as spam, across all network services. Customers are expressly prohibited from using our network to send UCE or to host websites advertised through UCE originating from any network. Violations will result in severe consequences, up to and including immediate service termination. Upon receiving a spam complaint, OCEANICHOST will initiate an investigation within 48 hours, during which the customer's network access may be restricted or temporarily suspended. If the investigation confirms a violation, we reserve the right to take immediate corrective action — including restriction, suspension, or termination of the offending account — without prior notice. OCEANICHOST may also pursue civil remedies to recover costs incurred during investigation and enforcement.

Shared & Email Hosting: Our Shared Web Hosting and Email Hosting services are intended exclusively for personal or legitimate business email usage through webmail or IMAP/POP3 clients. SMTP functionality is not supported on these plans, and the services are not designed for mass mailing, newsletters, or PHP-based mailing tools (such as those integrated with WordPress). Outbound SMTP connections via Port 25 are blocked by default. Due to the privacy-focused nature of our offshore infrastructure, IP addresses assigned to these services generally lack established reputations on public email blacklists, making them unsuitable for direct email delivery. All outbound emails are routed through Mail.baby, a third-party email relay service that is fully integrated and enabled by default on all shared and email hosting plans.

Customers are responsible for ensuring that their domains are not listed on the Spamhaus Domain Block List (DBL) and that proper DNS configurations — including MX and PTR records — are in place using our designated nameservers (third-party DNS management services such as Cloudflare are not compatible and may cause emails to be marked as spam). While OCEANICHOST strives to maintain optimal deliverability, inbox placement cannot be guaranteed, particularly for new domains or those with spam-like content characteristics. Domains listed on the Spamhaus DBL must implement DKIM, PTR, and MX records before submitting delisting requests; however, removal is not guaranteed. Our system employs stringent anti-spam filters, and rSPAM errors typically indicate blacklisted domains or flagged email content.

VPS & Dedicated Server Hosting: Port 25 is disabled by default on all VPS and Dedicated Server plans to prevent spam. Due to the privacy-oriented nature of our offshore network, IP addresses assigned to these servers generally lack reputation on public email blacklists and are unsuitable for direct email delivery. Customers requiring email functionality should use reputable third-party SMTP providers such as Mail.baby, MailJet, Mailchimp, or Brevo (formerly SendinBlue), which operate on trusted IP infrastructures. Establishing domain and IP reputation for direct email sending typically requires several months. IP addresses on our servers may appear on the Spamhaus Policy Block List (PBL), indicating a non-mail-server designation. While delisting is sometimes possible, we have proactively blocked Port 25 because the offshore nature of our hosting often results in persistent blacklisting. Domain names may also be listed on the Spamhaus DBL due to low reputation or spam-like activity; customers are responsible for configuring proper DNS protocols (DKIM, PTR, MX) before requesting removal. Delisting is neither guaranteed nor immediate.

By using our services, you agree to abide by these email policies and terms.

8. SECURITY

You are solely responsible for any misuse of your account, regardless of whether the unauthorized activity was carried out by a friend, family member, guest, employee, or any other party. You must take reasonable precautions to prevent unauthorized access to your account. Using your account to breach the security of any other account, network, or server is strictly prohibited.

  • Password Security: Your password grants access to your account. You are responsible for keeping it secure and must not share your credentials with unauthorized individuals. You will be held responsible for all activity conducted through your account.
  • Unauthorized Access: You may not attempt to circumvent user authentication or security mechanisms of any host, network, or account. This includes accessing data not intended for you, logging into servers or accounts without proper authorization, or probing the security of other networks.
  • Denial of Service: You may not attempt to interfere with service to any user, host, or network. This includes network flooding, deliberate attempts to overload a service, or any attempt to crash a host.
  • Legal Liability: Users who violate system or network security may be subject to criminal or civil liability.
  • Security Measures: You must implement adequate security measures to prevent or minimize unauthorized use of your account.

9. RESOURCE USAGE (SHARED HOSTING)

Users of Shared and Reseller hosting services are prohibited from the following activities:

  • Consuming 20% or more of system resources for periods exceeding 120 seconds (including CGI scripts, FTP, PHP, HTTP, etc.)
  • Running standalone, unattended server-side processes
  • Running any BitTorrent application, tracker, or client
  • Engaging in any file-sharing or peer-to-peer activities
  • Running cron jobs with intervals shorter than 10 minutes
  • Generating more than 300 HTTP/Port 80 requests per 30 seconds

CPU & Memory Limits: OCEANICHOST uses CloudLinux (LVE) to ensure fair resource distribution among Shared Hosting accounts. LVE is a kernel-level technology that leverages container-based virtualization and cgroups to prevent any single website from monopolizing server CPU, I/O, memory, or Apache processes, which would otherwise cause downtime for other users. If your website displays a "Resource Limit Reached" error, it means you have exceeded the allocated LVE limits for your hosting package. The specific limits for each plan are listed on our sales page.

10. DEDICATED & VPS SERVERS

Self-Managed Services: Unmanaged Dedicated Servers and VPS Servers are rented by customers and managed entirely by the customers themselves. OCEANICHOST provisions the server according to the customer's specifications (CPU, RAM, disk, network) and installs the chosen operating system. Customers may select their preferred OS; however, OCEANICHOST may recommend specific versions tested for optimal compatibility. After OS installation, our support responsibility ends. Customers receive root credentials, must change the default password upon first login, and assume full responsibility for all subsequent server management — including configuration, software installation, updates, security, backups, and ongoing maintenance.

IP Addresses & Mail Servers: Our servers are primarily intended for hosting websites and applications, not for operating mail servers. We cannot guarantee the cleanliness or suitability of our IP addresses for email delivery. If an IP is listed on Spamhaus or other blacklists, you are responsible for requesting delisting after configuring essential protocols such as DKIM, PTR, and MX records. Removal from blacklists is not guaranteed and may require patience and effort. You must demonstrate to blacklist authorities that the server is used solely for legitimate purposes. By purchasing our services, you acknowledge and accept these conditions.

Credentials & Control Panels: We do not retain server login credentials in our system; it is your responsibility to store them securely. VPS servers are delivered with a pre-installed operating system and control panel. Dedicated Servers do not include a control panel. You may contact us for OS reinstallation or server reboots as specified during the order process.

Backups: Offshore Dedicated Servers and VPS Servers are not backed up by OCEANICHOST unless an additional backup service has been purchased. Clients are responsible for implementing their own backup solutions. Additional storage for backup purposes is available on our Storage Servers page. Dedicated Server Cancellations: To cancel a dedicated server, you must submit a cancellation request at least 7 days prior to the billing due date. Dedicated servers are automatically renewed monthly through our data center agreement, and failure to provide advance notice will result in continued charges for power, hardware rental, and rack space. Additionally, timely payments are required for all active servers. If any payment is missed, it may affect the status of all your servers. For example, if you have two servers and fail to submit a 7-day cancellation request for one, the other server may be suspended until all outstanding balances are settled.

11. MIGRATIONS, BACKUPS & DATA LOSS

By using OCEANICHOST services, you acknowledge and accept all associated risks regarding data storage and loss. OCEANICHOST shall not be held liable for any data loss resulting from its services. We strongly recommend that you implement independent backup procedures and regularly test data restoration to ensure the integrity of your backup files.

Website Migration: Our migration service is provided as a complimentary courtesy. While our team will make every reasonable effort to ensure a smooth transition of your website to our platform, we cannot guarantee the availability, feasibility, or specific timeframe for any migration. The free migration service applies exclusively to Shared Web Hosting plans and must be requested within the first 30 days of your sign-up date. Migration requests submitted after this 30-day period will incur a predetermined fee.

Migration services are limited to cPanel and DirectAdmin transfers, in accordance with the control panels used for our web hosting services. We do not facilitate migrations for VPS or Dedicated Servers. Migration requirements for Shared Hosting are as follows: maximum file size of 5 GB and maximum SQL database size of 2 GB. Files exceeding these limits will incur additional charges — please submit a support ticket for assistance.

No Backups Provided: OCEANICHOST does not provide backups for any hosting service, including Shared Hosting, Linux VPS, Storage VPS, Windows VPS, or Dedicated Servers. Our services are self-managed and operate under an offshore privacy policy with a strict no-logs approach. It is your sole responsibility to maintain your own backups at all times. We are not liable for any data loss or corruption.

By not providing backups, we ensure that you retain full control over your data and backup processes. However, hardware issues such as disk failures can occur. To mitigate potential data loss, we strongly recommend configuring automated daily or weekly backups to an external storage solution (e.g., Google Drive, FTP, or similar services).

Please note that backup responsibilities are clearly stated in all activation and welcome emails. In the event of a data failure caused by our infrastructure, we will provision a replacement service and extend your subscription by one additional month at no extra charge. However, regular backups remain essential to avoid disruption.

Always ensure your backups are current and up to date.

12. SERVICE UPTIME

The following circumstances are excluded from any Service Level Agreement (SLA) uptime guarantees:

  • Internal services such as MySQL, Apache, PHP, etc.
  • DDoS attacks or network flooding
  • Scheduled downtime or planned maintenance
  • Service interruptions due to unpaid invoices, abuse notifications, or TOS violations
  • ISP or local connectivity issues
  • Customer-initiated or customer-controlled downtime
  • Acts of force majeure

OCEANICHOST reserves the right to modify this SLA at its sole discretion. Any changes will be published on our website and will take effect seven (7) days after publication.

13. SUPPORT

Ticket-Based Support: Customer support is provided exclusively through tickets submitted via our billing portal. Tickets are processed in the order they are received; submitting duplicate tickets or sending multiple responses will not expedite your request. Please note that our support team operates in English only.

VPS & Dedicated Servers: These services are unmanaged by default unless otherwise specified at the time of purchase. They are designed for experienced Linux administrators and webmasters who are proficient with GNU/Linux tools, operating systems, applications, and the security measures required to maintain system integrity.

Shared Hosting: Root administrative access is not provided for Shared Hosting services. OCEANICHOST manages and monitors the operating system and web server applications on your behalf. A web hosting control panel is provided for intuitive account management.

Liability: We are not liable for disruptions or issues resulting from your own management of the Services. However, if disruptions are caused by hardware, infrastructure, network, or virtualization issues within our area of responsibility, we will typically provide assistance upon request — either at no charge or for a mutually agreed fee.

You may contact us for support regarding the following:

  • Network-related issues
  • Server hardware issues
  • VPS control panel
  • OS templates and ISOs

Conduct: Abusive, threatening, or disrespectful language is strictly prohibited across all communication channels — including our ticketing system, online forums, and live chat. Violations may result in a warning and/or suspension of access to support services.

14. CANCELLATIONS & REFUNDS

Right to Terminate: OCEANICHOST retains the right to terminate any account at any time, with or without prior notice. Engaging in any form of staff abuse will result in immediate suspension or termination of your services.

Customer Cancellations: You may cancel your services at any time by submitting a cancellation request through the client control panel at least 7 days prior to the renewal date. Please note that cancellations submitted via support tickets or email will not be accepted.

Dedicated Server Cancellations: To cancel a dedicated server, a cancellation request must be submitted at least 7 days prior to the billing due date. Dedicated servers are automatically renewed monthly through our data center agreement, and failure to provide advance notice will result in continued charges. Timely payments are required for all servers; if any payment is missed, it may affect the status of all your active servers.

Refund Policy: OCEANICHOST generally does not issue refunds. The following exception applies:

  • Shared Hosting Plans: New customers are eligible for a 15-Day Money-Back Guarantee, excluding payments made via cryptocurrency.
  • Service Errors: Refunds may be considered within the initial 72 hours from the payment date if an error attributable to OCEANICHOST or an inability to provide the requested service occurs.

Non-Refundable Items: The following are not eligible for refunds under any circumstances: Dedicated Servers, Virtual Private Servers, SSL Certificates, VPNs, administrative fees, setup fees, custom software installation fees, domain name registrations, cryptocurrency transactions, account credits ("Add Credit"), and non-refundable licensing fees (e.g., cPanel, DirectAdmin).

Where a refund is deemed applicable, an administrative fee of 1% of the refundable amount (minimum €2.00 EUR) will be deducted. Initiating a dispute or chargeback through a payment processor may result in immediate service suspension or termination. Violating these Terms of Service nullifies any entitlement to a refund.

Payment Subscriptions: It is your responsibility to cancel any recurring payment subscriptions directly with PayPal or other payment providers. OCEANICHOST does not have access to user payment profiles and cannot cancel recurring subscriptions on your behalf. If you do not cancel your subscription, billing will continue, and charges will be applied as credit to your account balance for use toward future services and invoices. Credits are non-refundable. However, refunds for charges within the last 30 days may be issued to your original payment method if multiple months were charged in error.

Additional Conditions: Refund requests will not be accepted for products or services that are functioning properly or experiencing issues caused by the customer. Refunds are available only to first-time customers. Individuals who previously held an account, terminated it, and re-registered — or who have opened a secondary account — are not eligible for refunds.

OCEANICHOST reserves the right to refuse any refund request at its sole discretion.

15. PAYMENTS, SUSPENSION, TERMINATION & DATA RETENTION

Invoice Generation: Invoices for all hosting services are generated 7 days before the due date, and our billing system sends multiple reminders for outstanding invoices. It is your responsibility to provide accurate contact information to ensure timely receipt of these notifications.

Payment Methods: We accept the following payment methods: Credit Card, PayPal, Cryptocurrency (BTC, LTC, XMR, DASH, DOGE, USDT), PerfectMoney, and Wire Transfer. For PayPal payments, we may request verification of your PayPal email address. To ensure complete buyer anonymity, all cryptocurrency payments are converted to XMR (Monero).

Suspension & Termination Timelines:

  • Shared Hosting: Accounts will be suspended 1 day after the payment due date. If the account remains suspended for 4–5 days, it will be automatically cancelled and permanently removed from our servers with no possibility of data restoration.
  • VPS Servers: Services will be suspended 1 day after the payment due date. If the server remains suspended for 4–5 days, the service will be terminated and all data permanently wiped with no possibility of restoration.
  • Dedicated Servers: Services will be suspended if the invoice is not paid by the due date. If the invoice remains unpaid for 4–5 days and no communication is received (including requests for payment extensions), the server will be terminated. Once terminated or recycled, all data will be permanently lost.

In case of any payment delays, please contact us promptly to avoid service disruption.

Once a service has been terminated, hosted data cannot be restored or retrieved, as outlined in Section 11: Migrations, Backups & Data Loss. It is your responsibility to make timely payments and maintain independent backups to protect against data loss.

16. RESELLERS & PARTNERS

Resellers are responsible for providing technical support to their own clients. OCEANICHOST does not offer direct support to reseller end-clients. If a reseller's client contacts us directly, we reserve the right to temporarily suspend the client's account until the reseller assumes responsibility.

For security purposes, all support requests must be initiated by the reseller on behalf of their clients. Resellers bear full responsibility for all content stored or transmitted under their reseller account and for the actions of their clients. OCEANICHOST will hold resellers accountable for any client actions that violate applicable laws or these Terms of Service, and will work with the reseller to resolve any abuse issues.

17. AFFILIATE PROGRAM

Under the OCEANICHOST Affiliate Program, affiliates earn a commission of 20% on each qualifying first-time order placed through their custom tracking link. Commissions apply only to initial purchases and do not include recurring renewals.

Commission Rate: 20% on every first-time order placed through your unique affiliate link (renewals excluded).

Eligible Purchases: Commissions are earned on all qualifying first-time orders, excluding:

  • Domain registrations
  • SSL certificates

Cookie Tracking: Referred visitors are tracked via a cookie that remains active for 2 years from the initial visit. You will earn a commission if the referred visitor makes a qualifying first-time purchase at any point within that period.

Excluded Items: Commissions are not paid on service renewals or add-ons, including:

  • Dedicated IPs
  • Licensing fees
  • Custom installations
  • Other add-on options selected at checkout

If an affiliate order includes add-on configurations, the displayed order value may appear higher than the actual commissionable amount. The final payout will exclude add-ons and reflect the correct commission.

Minimum Withdrawal: The minimum withdrawal threshold is €10 EUR, with a maximum of €100 per withdrawal. A 35-day maturation period applies before payouts are processed, allowing time for chargebacks, cancellations, or potential TOS violations. Affiliates with a positive history may request expedited payouts by submitting a support ticket — we will review your affiliate history and may reduce the waiting period at our discretion.

Payout Processing: Payouts are processed on the same business day. We recommend opening a support ticket when requesting a payout, as we may not receive automatic notifications for payout requests. Mentioning in your ticket that a payout has already been requested will help us prioritize your request.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless OCEANICHOST — including its officers, directors, employees, agents, and third-party service providers — from and against any and all claims, demands, costs, expenses, losses, liabilities, and damages (including reasonable attorneys' fees) arising from: (i) your use of or access to this Website or the Services; (ii) your violation of any provision of this Agreement or any incorporated policies; and/or (iii) your violation of any third-party rights, including intellectual property or other proprietary rights.

The indemnification obligations under this section shall survive the termination or expiration of this Agreement and/or your use of the Website or its Services.

19. FORCE MAJEURE & LIMITATION OF LIABILITY

OCEANICHOST shall not be held liable for any damages your business may incur as a result of using our Services. All services are provided on an "as is" and "as available" basis, without any warranties — express or implied — including but not limited to warranties of merchantability or fitness for a particular purpose. This includes, without limitation, any loss of data resulting from delays, non-deliveries, incorrect deliveries, or service interruptions caused by OCEANICHOST or its employees.

OCEANICHOST disclaims all responsibility for any claimed damages — including incidental and consequential damages — that may arise from server downtime, service unavailability, or the corruption or deletion of any website or data hosted on OCEANICHOST servers, regardless of the cause.

OCEANICHOST reserves the right to amend these policies at any time.

20. NON-COMPLIANCE

Failure to comply with any of the terms and conditions outlined in this Agreement may result in a warning, suspension, or termination of your services. OCEANICHOST reserves the right to remove any account without prior notice. If your account is deactivated due to policy violations, all fees paid will be forfeited.

The following actions constitute grounds for immediate service termination:

  • Violating these Terms of Service
  • Any attempt to discredit OCEANICHOST or its services, including but not limited to threats, coercion of staff, or baseless legal threats
  • Using OCEANICHOST services for any illegal activity
  • Using OCEANICHOST services to store, distribute, or facilitate the distribution of illegal or harmful material

You are accountable for the actions of all users under your account and for any content they may create, modify, or control. These terms apply to all content hosted under your account, including content not directly uploaded by you.

OCEANICHOST reserves the right to modify these policies at any time without prior notice.
