Operation Offsides, targeting illicit streaming during the FIFA World Cup, seized more than 1,000 domains and was widely reported as a success. Yet the underlying message from authorities—that more aggressive legal tools are needed—suggests the seizure strategy has reached its practical ceiling.
The Technical Reality of Domain Seizure
Seizing a domain is administratively straightforward: work with registrars and registries to revoke or redirect the nameserver. The problem is that it addresses only the front door. When a domain vanishes, the infrastructure behind it—servers, databases, payment processors—remains intact. Operators can register a new domain in minutes, often across multiple jurisdictions where enforcement is weak or non-existent.
From a hosting and infrastructure perspective, the bottleneck isn't finding where content is served. It's the cost-benefit calculation for operators. A domain costs under ten pounds annually. Hosting in jurisdictions with lax DMCA enforcement (or no DMCA at all) costs marginally more than mainstream providers. When seizure takes weeks or months through legal channels, a new operation spins up faster than enforcement can act.
The real constraint on piracy isn't legal action against domains—it's payment processing and DDoS resilience. Pirate operations need to monetise through ads or subscription, and they need uptime. Those are harder problems to solve than changing a domain name.
Why Site Blocking Pushes Won't Solve the Structural Problem
Authorities and rightsholder groups are now advocating for broader site blocking legislation, particularly in the United States. The logic is intuitive: if ISPs are required to block access to infringing sites at the DNS or IP level, users simply cannot reach them.
This approach has been deployed in several European jurisdictions with mixed results. The technical cat-and-mouse game is immediate. Users route around ISP-level blocks through VPNs, proxy services, or direct IP lookups. Site operators migrate to fresh domains or use content delivery networks that obscure the actual hosting location. The enforcement cost rises sharply—now authorities must police not just the pirate site but the infrastructure ecosystem that enables circumvention.
More fundamentally, site blocking is a blunt instrument that requires sustained coordination between government, ISPs, and law enforcement. It works best in jurisdictions with strong centralised control and limited privacy expectations. In countries where privacy hosting and VPN use are common, or where multiple independent ISPs compete, the operational friction multiplies.
The Jurisdiction Arbitrage Problem
Piracy thrives because of arbitrage. A domain registered in one jurisdiction, hosted in another, with payment processing in a third, and users spread globally creates a coordination problem that no single enforcement action can solve. Even aggressive seizure campaigns must navigate mutual legal assistance treaties (MLATs), conflicting sovereignty claims, and the simple reality that some hosting providers and registrars have no incentive to cooperate.
This is why offshore hosting—particularly in jurisdictions that don't enforce US copyright law—remains a structural fact of piracy infrastructure. Operators don't hide because they're technically sophisticated; they hide because the legal framework makes it easier to operate across borders than to comply within them.
What Actually Works, and What Doesn't
Seizure campaigns like Operation Offsides disrupt specific operations and create short-term friction. They also generate deterrent value: operators know that sustained visibility attracts enforcement. But they are not a scalable solution to piracy.
The approaches that do show sustained impact operate at the payment and infrastructure layers. Targeting ad networks that monetise pirate sites, pressuring payment processors to drop high-risk merchant accounts, and pursuing the individuals who operate infrastructure—these require ongoing investigation rather than batch domain takedowns.
Legislative pushes toward site blocking reflect frustration with this reality. Policymakers want a tool that feels proportionate to the scale of the problem. But the technical and social infrastructure of the modern internet makes centralised blocking difficult to maintain, and creates perverse incentives for VPN and privacy hosting providers to market themselves as circumvention tools.
The honest conclusion is that piracy enforcement will always be reactive and fragmentary. No single policy or technical measure eliminates the fundamental asymmetry: operators can relocate faster than authorities can pursue, and users can circumvent faster than ISPs can block. Operations like Offsides matter for specific cases, but treating them as a template for broader strategy misses the real problem—which is structural, not procedural.
